Quick Jobs Japan Terms of Service

1. DEFINITIONS

The definition of terms in this agreement is as follows.
  1. "Recruitment Information" means information of recruitment posted on the Services,and means information in both Japanese and foreign languages.
  2. "Business Operators",means business operators that post Recruitment Information on the Services.
  3. "Our Company","we","us",or "our" means readytowork Inc.
  4. "Anti-Social Forces" means an organized crime group, a member or semi-regular of an organized crime group, a related company of an organized crime group,racketeer groups,groups engaging in criminal activities under the pretext of conducting social campaigns or political activities,crime groups specialized in intellectual crimes,and any other equivalent person of above.
  5. "Services" means the Recruitment Information website for foreigners and related services provided by us under the name "Quick Jobs Japan"(the name after any change will also be included).
  6. "Service Information" means the guide, manuals, precautions for use, and other information of the Services that we publish on our website or other places..
  7. "User","you","your"or "yourself" refers to the person who uses the Services other than Business Operators, and includes those who simply browse the Services.

2. USER INFORMATION

  1. Your personal information shall be handled in accordance with the privacy policy(https://quickjobsjapan.com/privacy) prescribed separately by us, and you shall agree that we handle personal information in accordance with this privacy policy.
  2. We may collect or analyze records and personal information obtained for the Services and process them so that individuals shall not be identified, and then create statistical data, and we may use these date without any restriction(including, but not limited to use for provision to third parties, sales of the Services, market research, development of new services, etc.)

3. APPLICATION OF THESE TERMS

6. NON_GUARANTEED EFFECT

We do not guarantee anything about that you will be able to obtain a job in line with your wishes or other effects by using the Services.

7. CHANGES TO THESE TERMS

  1. We may change the contents of these terms or the Service Information at any time in our discretion.If we make changes,we will determine the effective time of the change, and notify you of the effective time, the new contents of the terms and the Service Information in an appropriate manner in advance.
  2. If you continue to use the Services after the above change, you are deemed to agree to the changed terms and Service Information.

8. ACCOUNT MANAGEMENT

  1. You shall assume full responsibility for the use and management of the ID and password given by us.The use of the Services performed with the above ID and password shall be deemed to be operated by you,and you shall consent to this in advance.
  2. You shall not allow third parties to use the above ID and password, or assign, or hypothecate, or otherwise dispose of them.

9. PROHIBITED ACTS

You shall not perform the acts set forth below (including the acts of inducing them and the acts of preparing them) when using the Services.
  1.   Acts that violate the laws, notices, principles, guidelines, etc. applicable to you.
  2.   Acts that declare false or incomplete information when using the Services.
  3.   Acts that provide false information to us.
  4.   Acts that are contrary to social norms or public order and moralities.
  5.   Acts that violate the rights of us, Business Operators, other Users or third parties.
  6.   Acts that post tools or programs, etc. that destroy or interfere with the functions of software or hardware, etc. used by us, Business Operators, other Users or third parties.
  7.   Acts that may overload all or part of the system related to the Services, such as using automatic patrol programs, etc.
  8.   Acts such as reverse engineering, decompilation, disassembling or other similar acts on the Services.
  9.   Acts that destroy or interfere with the functions of our servers or networks.
  10. Acts that use unintended operations of us (including but not limited to defects, bugs, malfunctions), or intentionally tampered data, or programs not approved by us (hereinafter referred to as “Misuse”) for the purpose of making a profit for yourself or third parties.
  11. Acts that develop, distribute, or use tools or programs for the purpose of Misuse,or induce, solicit or assist these acts to third parties, or acts with these kinds of fear.
  12. Acts that interfere with the Services.
  13. Acts that collect or accumulate information of other Users or Business Operators beyond the scope necessary for using the Services.
  14. Acts that use the Services for the purpose different from the intent of the original provision.
  15. Acts that use the Services with ID and password of other Users or Business Operators.
  16. Acts that obtain ID or password of the Services from other Users or Business Operators.
  17. Acts that directly or indirectly provide benefits to Anti-Social Forces in connection with the Services.
  18. Acts that damage the honor or credit of us, Business Operators, other Users or third parties.
  19. Acts that dispatch obscene drawings, words or expressions.
  20. Acts that dispatch fraudulent, violent or threatening expressions.
  21. Acts that dispatch information which guides to sites considered inappropriate by us, such as adult sites, one-click fraud sites, and sites that aim to disseminate harmful computer programs such as viruses, etc.
  22. Acts that copy, reproduce, redistribute, etc. the Services or the information of the Services (including but not limited to Recruitment Information), regardless of whether it is copyrighted material.
  23. All other acts that we deem inappropriate.

10. SUSPENSION OF USE

  1. We may suspend or stop providing the whole or part of the Services to you during the period prescribed by us without notice if we find that you have performed the prohibited acts described in the preceding article.
  2. Even if you suffer damages due to the measures of the preceding paragraph,we shall not be obligated to compensate.

11. TERMINATION AND INTERRUPTION OF THE SERVICE

  1. We may terminate the Services at our discretion by notifying you in advance in a manner that we deem appropriate.
  2. We may temporarily suspend all or part of the Services without notifying you in advance when events below occur:
    1.   When performing maintenance related to the Services regularly or urgently.
    2.   When the load is concentrated on our system due to excessive access or other unexpected factors.
    3.   When there is a need to secure the security of the Users or Business Operators.
    4.   When service of the telecommunications carrier is not provided.
    5.   When it is difficult to provide the Services due to unavoidable natural disasters, or legal reform,etc.
    6.   Other cases when we deem necessary in accordance with preceding items.
  3. We shall not be liable for any damages caused to you by our measures under this article.

12. REGISTRATION CANCELLATION

  1. We may cancel your membership registration immediately if any of the cases below occurs to you.
    1.   When you violate any of these terms.
    2.   When it turns out that you have been suspended from using the Services or the contract with us has been canceled by us in the past.
    3.   When you received attachment, provisional attachment, provisional disposition, disposition of tax delinquency, or other public authority disposition.
    4.   Other cases when we recognize that you are inappropriate for using the Services.
  2. We shall not be liable for any damages caused to you due to the cancellation of the membership registration based on the preceding paragraph.

13. CONTENTS AND SPECIFICATIONS

We may change the contents and specifications of the Services without notice, and you may not dispute this.

14. ENTRUSTMENT

We may entrust all or part of the business related to the Services to third parties at our discretion.

15. INTELLECTUAL PROPERTY RIGHTS

Intellectual property rights such as patent rights, copyrights, design rights, utility model rights, trademark rights, etc. related to the Services and Recruitment Information shall belong to us or a third party who is the right holder.

16. DISCLAIMERS

  1. The Services are provided "AS IS", and each function of the Services shall be provided by us at the time of provision.We disclaim all warranties about the Services to you including that the Services conform to your specific purpose, have the expected functions, realize the expected results, do not cause any problems, and the use results.
  2. You shall backup your data at your own expense and responsibility.We shall not be liable for any loss or damage of data with the use of the Services, regardless of the reason.
  3. We do not guarantee the contents of the Recruiment Information at all and you are responsible for checking the contents.In the event of a dispute between you and a Business Operator or any other third party regarding the Services, you shall settle at your own expense and responsibility without causing any inconvenience to us, and compensate for the damage that we suffered from this.
  4. You shall confirm whether you violate any laws, notices, principles, guidelines, etc. applicable to you in using the Services at your own expense and responsibility,and we do not guarantee anything and shall not be liable for this.
  5. With regard to the information on the websites linked to from the Services, except for those websites that managed by us, we do not guarantee anything about the accuracy, freshness, legitimacy, completeness or benefits, etc. We shall not be liable for any damages caused to you from the linked website.
  6. Even if we are obligated to indemnify you for damages by laws, the obligation for damages shall not exceed 1000 yen, and we shall not be liable for any damages other than direct and actual damages suffered by you.

17. THIRD-PARTY SERVICES

  1. The Services may cooperate with services operated by third parties other than us (hereinafter referred to as "Third-Party Services").However,we do not guarantee that such cooperation will continue.

18. CONFIDENTIALITY

  2. Notwithstanding the provisions of the preceding paragraph,the following information shall not be included in Confidential Information.However, personal information shall be included in Confidential Information even if it falls under the following.
    1.   Information which is generally known to the public at the time of disclosure or getting to known.
    2.   Information which has become generally known to the public after the time of disclosure or getting to known for reasons not attributable to you.
    3.   Information which is already obtained at the time of disclosure or getting to known.
    4.   Information which is obtained from duly authorized third parties.
    5.   Information which is obtained from duly authorized third parties.
  3. Notwithstanding the provisions of paragraph 1, you may disclose Confidential Information based on a law, an order, a requirement or request of a court or government agency.

19. NOTIFICATION

  1. When notifying you in connection with the Services,we may execute by the method that we judge as appropriate, such as posting on the Services or our website or sending emails or documents to the registered email address or address.

20. EXCLUSION OF ANTI-SOCIAL FORCES

    4.   You yourself or using third parties conduct the following or equivalent acts on the other party:
      1. ①  Violent requets or acts.
      2. ②  Improper requets or acts beyond legal responsibility.
      3. ③  Acting in a threatening manner or using violence in connection with transactions.
      4. ④  Acts to damage the other party's credit or interfere with the other party's business by spreading rumors,or using fraudulent means,or by force.
  2. We may cancel your membership registration if you violate the preceding paragraph.
  3. We shall not be liable for any damages caused to you due to the cancellation of the membership registration based on the preceding paragraph.

21. SURVIVAL CLAUSE

Even if the membership registration of you is canceled or if the contract between you and me based on these terms is terminated, Article 2, Clause 3 and Clause 4 of Article 5, Article 6, Clause 2 of Article 10, Clause 3 of Article 11,Clause 2 of Article 12,Article 15,16,17,18,19, Clause 3 of Article 20,Article 21,22,23,24,25 shall survive.

22. ASSIGNMENTS OF RIGHTS AND OBLIGATIONS

  1. Except for the case with prior consent of us,you may not assign, succeed, hypothecate, or otherwise dispose of the contracted User rights or obligation, or contractual status under these terms to third parties.Except for the case with prior consent of us,you may not assign, succeed, hypothecate, or otherwise dispose of the contracted User rights or obligation, or contractual status under these terms to third parties.
  2. When we assigned the business related to the Services to third parties,we may assign contractual status,rights,obligations under these terms,or any information about you to the assignee with the assignment,and you shall agree to this in advance.

23. SEVERABILITY

  1. Even if any clause or part of these terms is judged to be invalid or unenforceable,the judgement shall not affect the other parts, and the remaining of these terms shall continue to be valid and enforceable.You and me shall endeavour to ensure the same effect as the invalid or unenforceable clauses in accordance with all or part of the meaning of these clauses,and you shall agree to be bound by the amended terms.
  2. Even if any clause or part of these terms is judged to be invalid or unenforceable in relation to a certain User, it shall not affect the effectiveness, etc. in relation to other Users.Even if any clause or part of these terms is judged to be invalid or unenforceable in relation to a certain User, it shall not affect the effectiveness, etc. in relation to other Users.

24. GOVERNING LAWS AND JURISDICTION

  1. The laws of Japan shall apply to the interpretation and application of these terms.
  2. The Tokyo District Court or Tokyo Summary Court shall be the court of exclusive jurisdiction by consent of the first instance for all disputes concerning these terms.

25. LANGUAGE

If there is any contradiction or conflict between the Japanese version of these terms and the translated version of a language other than Japanese, the content of the Japanese version shall be applied with priority.
